Appendix C – standard conditions for hosting solution

(addendum to general terms and conditions)

 

 

 

Application

This appendix to the General terms and conditions for On720.com A/S ("On720") applies to all agreements on hosted solutions between On720 and the customer, including agreements on backup, storage, hosting of servers and websites, etc.

The terms and conditions in this appendix apply together with the general terms and conditions for On720, unless they are specifically deviated from in the offer or order confirmation from On720.

The conditions in this appendix take precedence at all times over any standard conditions sent by the customer.

 

Appointment

An agreement is only concluded when On720 has sent order confirmation or On720 has signed an agreement signed by the customer on the development, purchase or implementation of hosting solutions.

 

Subcontractors

On720 uses subcontractors for the delivery of hosting solutions.

 

Prices

Prices appear in On720's price lists or are stated in the order confirmation or contract sent to the customer.

All prices are excl. VAT, unless otherwise stated.

Price increases

 

Business conditions of subcontractors

The terms and conditions for a sub-supplier of hosting solutions chosen by On720 apply directly in the relationship between the customer and the sub-supplier, once the customer has been made aware of these terms and conditions.

Hosting solutions provided by a subcontractor are covered by the subcontractor's terms and conditions, which are provided to the customer when the hosting agreement is entered into. On720 assumes no responsibility for losses resulting from errors and omissions in the hosting solution provided by the subcontractor.

On720 assumes no independent responsibility for delays, downtime, malfunctions or defects of a hosting solution provided by a subcontractor.

 

Limitation of liability

In addition to what is stated in the general terms and conditions for On720, the responsibility for correctly setting up hosting solutions, ongoing control of functionality and validity of the service (including backup) rests with the customer, unless another agreement, including remuneration for this, has been entered into in writing with On720.

On720 assumes no responsibility for losses, including operating losses, losses due to downtime or other indirect losses, which are caused by downtime on a hosting platform, faulty backup, loss of data or other errors and shortcomings of a subcontractor's hosting solution.
